  1. The RNC Chair position being vacant after JCD was signed out for inactivity, we will be having a Chair Election.

     

    Please note that the Chair will be responsible for our upcoming 2022 Midterm Election campaigns. This is an extremely important role (and a good way to build a national profile).

  2. Mr. President pro tempore,

     

    I rise to commend on this bill, the American Data Privacy and Protection Act. I appreciate the sponsor's work on this issue, which is all the more important given recent data breaches that have received media coverage. I appreciate the fact that we need a single, national standard instead of a quilted patchwork of state-based policies that contradict each other.

     

    That said, I cannot support this bill as it stands without a few amendments that I will now propose.

     

    Fisk I

    Strike:

    • Section 203(a)(1)(c)(3)
    • Section 203(e)(3)(A)(ix) and (xi)
    • Section 206(b)(3)(C)(i)(I) and (II)
    • Section 208(b)(4)
    • Section 302(a)(6)

    The Fisk I amendment will remove the right to deletion of data. As we have all learned in this digital age, nothing on the Internet can be truly lost. Requiring entities to delete data would be overly burdensome. Data belongs to both parties, the individual and the owner of the data. So, the federal government weighing in and requiring the data owner to relinquish their ownership is concerning to me. 

     

    Fisk II

    Amend Section 209(b)(1)

    Quote

    (1) The covered entity or service provider’s average annual gross revenues during the period did not exceed $41,000,000, which shall be adjusted annually by inflation or 2%, whichever is greater.

    This amendment simply allows the small business threshold to be adjusted for inflation or, if inflation is less than two percent, it would be adjusted by 2%. If we enact this law today, for instance, formerly small businesses may end up being captured in the regulatory requirements of this bill. That is why adjusting for inflation is a sensible step.

     

    Fisk III

    Strike Section 403

    This amendment would remove the private right of action. Only class action lawyers stand to gain from this provision. The reality is the FTC and state governments are more than capable of enforcing antitrust law, and creating a new private right of action will lead to a more litigious society. I believe we should trust our FTC and state attorneys general to enforce this new powerful tool. If we find that a private right of action is needed down the line, it may be worth considering in a future law.

     

    Fisk IV

    Section 404(b):

    • Strike (2)(M) and (2)(R)
    • Strike (3)

    Last, but certainly not least, is the Fisk IV amendment. This amendment ensures that we have a truly national standard and overzealous states cannot override that national standard.

     

    I would emphasize that, for me and I believe my caucus, I would need to see at least Fisk IV and either Fisk III or Fisk I and II adopted to support this bill and help is attain cloture and passage in the House.

    Do you believe our welfare system is too generous to those who don't work?

    Do you support any tax increases on Americans? What about a capital gains tax hike?

    Do you support the Affordable Care Act?

    Do you support the Paris Climate Accord?

  4. Senator Fisk is Leading on Foreign Policy

    WASHINGTON, DC -- Senate Minority Leader Daniel Fisk (R-NE) recently attended White House bill signings for his Counter Chinese Communist Party Influence Act and the Supporting Democracy and Peace in the Persian Gulf Act, which he introduced alongside former Senate Majority Leader Lance Reed (D-RI). "These bills, alongside other Republican foreign policy bills that have been sent to the White House this Congress, show that my Republican Party and I are leading on foreign policy. While Democrats struggle to get their feet underneath them, we have been able to advance these hard-hitting, yet commonsense bills through the legislative process and see them signed into law," said Senator Fisk. "By finally getting tough on China and calling out the Iranian regime, I am proud of the work that's been done."

     

    The Counter Chinese Communist Party Influence Act "will de-platform malignant Chinese technology platforms, kick their propaganda entities out of our schools, end preferential tax treatment towards China, and enact severe sanctions against the Chinese regime for its human rights and international law violations," said Fisk. "This bill is the result of many painstaking meetings, hundreds of hours of work, and has led me to be personally targeted by the CCP. Nonetheless, its passage is a testament to our nation's diplomatic and soft power resolve against Red China." Addressing his Persian Gulf law, Senator Fisk said, "Congressional Republicans have finally secured a legislative withdrawal from the disastrous Obama-era Iran Nuclear Deal. We prohibited arms sales to Iran and imposed severe sanctions on the Ayatollah and his close associates. And we tackled Iranian proxies, such as Hezbollah." Concluding his remarks, Senator Fisk said, "Republican leadership in the House and Senate have been working tirelessly to keep Americans safe. I am proud that these laws have been enacted to keep Americans safe and defend our interests abroad."
